Agency Workers Regulations The Agency Workers Regulations are to come into effect on 1st October 2011. The intention for The Regulations are quite straight forward 'To provide agency workers the entitlement to the same or no less favourable treatment with respect to basic employment and working conditions, if and when they complete a 12 week qualifying period'. There will be two key stages of the Agency Workers Regulations: 1. As of 1st October 2011 temporary workers will be entitled to access the same facilities as permanent staff some of these facilities include staff canteen, staff parking and child care facilities. It will be the hirer or the end client that will take responsibility for agency workers to have access to these facilities. 2. Contractors and temporary workers employed at a location for 12 weeks or longer will be entitled to the same benefits and rate of pay as permanent employers. These benefits will include pay and bonuses, duration of working time, and annual leave. The recruitment company is initially held responsible for any disputes over these benefits. Contractors and temporary workers will be able to bring forward claims at an Employment Tribunal if they feel that companies aren't complying with the agency workers regulations. The regulations also include anti-avoidance rules which allows temporary workers to claim compensation if employers decide to terminate contracts after 11 weeks. An agency worker is someone who has a contract with the TWA but works temporarily for and under the direction and supervision of a hirer. The key elements for someone to be agency worker are: • There is a contract between the worker and a TWA. • That worker is temporarily supplied to a hirer by the TWA. • When working on an assignment the worker is subject to the supervision and direction of that hirer.
