HIPAA regulations, the result of the HITECH Act of 2009, now carry many new changes, at least four of which are radically different from existing rules. Firstly, the role of a Business Associates (BA’s) and how they are covered has changed. They are now covered directly under Privacy Rule’s use and disclosure limitations and the Security Rule’s safeguard provisions, and will be directly responsible for compliance with the regulations. Secondly, BA’s also now have a new definition, and this is explored in this session. Their sub-contractors are also now part of being BA’s, and this calls for a new approach on what needs to go into a Business Associate agreement the BA establishes. Thirdly, the rights of individuals to receive electronic copies and request for certain kinds of information to be withheld have been strengthened and expanded. This calls for a review of existing rules. Fourthly, since BA’s have now emerged as the leading source of health information breaches, they need to implement good practices into their business to avoid penalties. This webinar will explore each of these sections in detail.
