Different states have different laws for charitable solicitation. Different states impose different requirements for state charitable solicitation. Different states can be classified into four main groups on the basis of requirements laid down by them. Four categories in which different states are divided are:
- Some states do not have any state charitable solicitation requirements
- Some states check frauds in relation to charitable solicitation and impose penalties if found guilty. The laws in such states include that the donors should provide their complete information in regards to their donation and if they fail to provide this information it is considered as a fraud.
- Some states have form filling and registration requirements on commercial fundraisers and they charge fee for soliciting on behalf of charitable organization.
- Some states have form filing and registration requirements on the charitable organizations. But they provide exemptions to churches and to charitable organizations who receive donations from their members only.
In addition to state charitable solicitation requirements and laws laid down by some states, many states have laws that regulate charitable solicitation. These charitable solicitations include:
First it includes personal solicitations or face to face solicitations. It includes the solicitations that are made in public or by going on the door.
Secondly, it includes solicitations that are made by commercial fundraisers.
Internet facility for making charitable solicitations is not provided by many states as it can lead to fraud solicitations. A state agency is responsible to check and find out which charitable organizations are not in compliance with state charitable solicitation requirements and may take suitable action if any charitable organization is found to be in non-compliance with the requirements.
Many states have laid down state charitable solicitation requirements if they are made from out of state.
All charitable organizations should check these rules and regulations before demanding any funds from out of state agencies to remain legal. These days most charitable organization are making use of internet to raise out of state funds and it is required that they should register themselves with the state and should comply with all the rules and regulations laid down by any particular state to carry out its activities through internet to collect out of state funds. There are only few states that provide such a facility.
In some states, a state agency may ask a charitable organization and request it to register to solicit and tell them about the basic requirements for state charitable solicitations. Some states may take an immediate action and impose penalties according to the state rules.
