Most people when they are planning to marry do not realize that once that have said their "I do's," they should be thinking about getting new wills created as a couple. Of course, when you are just starting your lives together, the last thing you may want to think about is writing a legal will, but it is the responsible step to take. In addition, having a legal will does not mean that you or your spouse is going to die the next day; it is just a fact, albeit perhaps unpleasant, that eventually, you and your spouse will pass on.
When you have no will when you're married, you are just hoping for the best, but planning and having a legal will is not just important, it is the responsible choice. Of course, getting a legal will does not mean you are rushing the event along, the best advice is to get the will written, make sure everything is legal and then put it away. If aspects of your life change, such as having children, you can always modify the will so that it is current.
One of the nicest aspects is that legal wills are very inexpensive to write and to have finalized. Therefore, there is no reason not to have a will written as soon as you have married, because it makes the most sense. Chances are the two of you will live for many more years, but being prepared is always the best approach.
Have you ever been to an estate sale that ended up being distributed via the court systems? It is not pleasant, but what can happen when there is not a will, no one knows what the person wanted, and even if someone did, if it is not in writing, it does not make a difference to the courts. Estates that have been a part of a legal battle in a family is a very sad situation because the person that died surely did not mean to begin a war within the family, but not having an iron clad will often divides families.
Therefore, be smart and get your will taken care of shortly after the wedding. When creating each of your wills, be sure to have a primary executor and a secondary executor, because if you have no secondary executor and the primary is no longer living, there will be no one in charge of your will. Remember, that when you create a new will, any wills that you currently have are cancelled immediately upon signing the new will.
While no one likes to think about the day he or she may lose their spouse or think about their own death, eventually, everyone dies. Therefore, planning early and making sure you always have your will up-to-date is crucial because if you draw up a will when you marry, then have five children, but never revise it to include your children, upon your death, they would get nothing.
Therefore, as life changes, make sure you update your will according to your wishes upon your death.
