I practiced law for over fifteen years in St. Louis, Missouri before stopping practice and shifting my efforts to my website, http://YourLegalLegUp.com. While practicing, I represented hundreds of clients in consumer law cases and won numerous awards of monetary compensation, damages and punitive damages, credit reparation, and release from contract. I was also able to put a number of unscrupulous businesses out of the business of defrauding consumers and saved thousands of potential victims from the schemes.

My practice ultimately shifted towards consumer debt litigation and third-party debt cases because so many thousands of the cases were being filed - just in St. Louis - where people were defaulting for lack of representation. Eventually I came to the conclusions that many citizens didn't know their rights and couldn't afford an atto ey, but that they could effectively represent themselves against the debt collectors if they had a little help. Therefore, I created YourLegalLegUp.com, the YourLegalLegUp Litigation Manual and Forms, and other information available at my site as a part of my campaign to empower regular people to defend themselves and protect their financial future.

As you will see, the website contains a great deal of information, much of it free, to help people understand their situation and begin to defend themselves from debt collectors. I have also posted extensive videos and articles on the subject.

Risk and value are two sides of the same coin in litigation. Having a firm understanding of what the debt collector thinks its risking when it goes after you versus what it thinks it can get will allow you to change that equation so the debt collector decides to drop the case against you and go after someone else. Most debt reduction plans play a sort of “chicken” with your creditors. The way they work is that, when your situation becomes really dire, you stop paying as many bills as you can and start saving a pot of money that you will eventually use to pay all of them off at the same time. When you have saved enough, and when your creditors have become desperate enough, you negotiate to make them go away. It sounds like a plan that might work – and it often does.

I have sometimes spoken of the Fair Debt Collection Practices Act (FDCPA) as both a “shield” and a “sword” - a fairly common legal metaphor for a law which has both offensive and defensive capabilities. Let's consider a few of those capabilities in this article. FDCPA as a shield
